Since the establishment of the chambers in 1990, lawyer Dr. Stefan Haupt has focused on copyright, publishing and media law. These areas of law are currently undergoing a dynamic development and require particular dedication.

Through the engagement of lawyer Ronald Schmidt, the chambers broadened its expertise to include trademark, internet and multimedia law.

With her extensive experience, lawyer Kirstin Linß supervises employment law (with a particular focus on media), general civil law and commercial law (advice for medium-sized businesses and debt collection).

Lawyer Loy Ullman, specializing in competition law, press law and personal rights, completed the team when he joined the chambers in 2005.

With this range of specialization, complex issues spanning different areas of law relevant to the focus of the chambers can be dealt with even more effectively and collaborations
in the interest of the client can be formed.
The chambers are based in the centre of Berlin. Initially situated in the Hackescher Markt, it is now not far away at 65, Oranienburger Straße. This location demonstrates a close connection with the legal issues concerning the media and communications institutions
and associations situated within the city district.
Alongside legal representation, legal advice constitutes a large proportion of legal work. This includes for example the prosecution of legal infringements, legal enforcement of claims or extended legal advice on drafting or managing contracts in the relevant fields
of activity.
In addition, the chambers' lawyers have ensured that their knowhow is at the disposal
of their colleagues and any interested members of the public in the form of numerous publications (technical papers and books). These include a collaborative work on the volume »Electronic Publishing« and the »Berlin encyclopedia of copyright« (Publisher Medien und Recht, Munich) series, edited by the founder of the chambers, Dr. Stefan Haupt.

Areas of expertise

As the focus of the chambers is on media law, we pay particular attention to the handling of media law mandates that come under the heading of employment law. Employment law can always be applied when a worker or employee has work to complete subject to their employer.

Internet law concerns the legal appraisal of circumstances arising from the interaction of internet users. Owing to the structure and technology of the internet, conventional legal interpretation must be modified to allow for its application to online issues. Problems arise as a result of the fact that content available on the internet may be accessed anywhere in the world.

Trademark law constitutes the foundation for differentiating between goods and services provided by the competitor, thereby providing the consumer with a system of reference. Brands, names, companies, business terms and geographical origins are all forms of identification which are protected by law. This protection arises from a multitude of sources, particularly from trademark law, the code of commercial law and the code of civil law.

Media law has established itself as an overall area in connection with the activities of the media as well as with the rights and claims of all those involved. Media law is rooted in article 5 of the constitution on the freedom of the press and freedom of expression. The statutory foundation for media activity consists of the national press law, national broadcasting regulations and the national media law

Multimedia law is concerned with legal problems which arise though the marketing of digital products with elements such as text, images, audio and video available both on and offline. In such situations, it is necessary to align general conditions of copyright and publishing law with technical particulars, particularly with the complexity of the combination of different elements.

Every individual has personal rights with regard to their public portrayal. Relevant to this is the law surrounding one's own image, written or spoken word or protection of privacy. For example, the law states that images of people may only be distributed or put on public display with the consent of the person pictured.

Copyright and Entertainment law deals with authors' moral rights and exploitation rights. Related property rights also come under this heading. Relevant copyrighted services are rendered by writers, journalists, composers, photographers, visual artists, designers, architects, directors, academics, scientists, programmers and others. The basic principle is that the creator should be able to decide how, when and in what form his work will be published and to what extent it may be altered.

Publishing law regulates a subdomain of copyright publishing laws, that is to say the rights and responsibilities of the publisher and creator of literary or musical works in relation to their use. The publishing contract obligates the publisher to adequately duplicate and distribute the work and to pay the author accordingly. As an expression of the exclusive grant of rights to the publisher, the author is obliged to refrain from using the material for any other purpose.

Business and corporate legal advice for concerns with limited liability would come under the heading of commercial law. Questions with regard to the formation of company charters, contribution of capital, maintenance of capital, shareholders' meetings and appointments or even the terms of employment for a company director deserve to be answered just as fully as questions on the cessation and settlement of businesses or on the responsibilities of a partner in the founding of a business or limited liability company.

Fundamental civil law also has an effect on numerous corporate fields of activity. To take an example the enforcement of outstanding debits comes under the umbrella of civil law.
It is not unusual for small and medium-sized businesses to come up against the problem in which the contractually agreed services have been rendered but payment has not been received.
